Edinburg Police Foiled In Attempt To Give Pot To State Prison Inmates, Apparently

They do things different down in the Valley. Like, if you're a police department, you donate some marijuana to inmates at the local state prison.

Oh sure, Edinburg police are saying it was all a mistake, and no way did they intend to give 25 pounds of pot to inmates by cleverly concealing it in a truckload of bananas, but come on, man -- it's the Valley.

We're just surprised they went to the trouble of hiding it.

The McAllen Monitor reports that Edinburg police sent a truckload of bananas and other fruit to the TDCJ's Segovia Unit, a common practice since the fruit had been confiscated in a drug raid.

About 1,000 pounds of pot was confiscated in that incident, police said. Trouble is, there was apparently 1,025 pounds of pot in the truck.

The weed was discovered while inmates working in the kitchen were unpacking the delivery. In what must be considered either the Upset of the Year, or evidence that prison truly can be redemptive, one inmate reported the pot to guards.

That inmate was later killed in the shower. (Not really.)

"We always inspect those donations before they are delivered," Edinburg police chief Quirino Munoz told the Monitor. "I guess these drugs were inadvertently missed by the officers and our drug dogs.

"Yep. We're buying it. Those drug dogs miss 25 pounds of pot all the freakin' time.

Obama is giving power to the Federal Reserve regulate and control private banks. For those of you who don't remember, Obama appointed Former President of the New York Federal Reserve Timothy Geithner to the position of the U.S. Treasury Secretary. Now, Obama and Timothy Geithner are creating the opportunity for the Federal Reserve to take over banks for free just as the Unions took a large percentange of GM and Chrysler.

Under the Federal Reserve is the Office of Inspector General (OIG) which conducts independent and objective audits, inspections, evaluations, investigations, and other reviews related to programs and operations of the Board of Governors of the Federal Reserve System (Board). This would be the "watchdog."

But how effective would it be if the Inspector General could be fired by President Obama or Timothy Geithner when Obama fired Inspector General of the Corporation for National and Community Service, Gerald Walpin when he investigated Obama's buddy.

Obama is appeasing the Muslim Oil Producing Nations. Yes, you can say Bush and Halliburton and Cheney and Republicans but what you won't say is Muslim and Obama and Middle East and rising gas prices.

So what's keeping oil relatively cheap? The belief that we have enough oil reserves, a bad economy and a strong dollar.

In the recent article "America's first Muslim president?," Frank J. Gaffney Jr. gives several points on why Obama may be a Muslim. I will touch on one. In his recent trip to Cairo, Egypt, Obama stated that he looked forward to the day ". . . when Jerusalem is a secure and lasting home for Jews and Christians and Muslims, and a place for all of the children of Abraham to mingle peacefully together as in the story of Isra, when Moses, Jesus and Muhammad (peace be upon them) joined in prayer."

Quaint enough, but why the "peace be unto them?"

As stated in "Islam -- An Alternative to Chaos," Muslims believe emphatically in the existence and the message of the earlier Prophets ‑and Muslims are cautioned by God in the Qur`an not to mention the Prophets names without adding, "Peace be Unto Them".

This not only applies to Abraham and Moses but particularly in the case of Jesus whom the Muslims call: "Isa‑Ibnu Maryam", (Jesus the son of Mary) who is revered as "Ruh‑Allah" the Essence (soul) of God.

There is a lengthy Chapter in the Qur`an entitled Maryam (Mary)‑ and For your information the Qur`an supports her Virgin birth and the Miraculous Powers that were given to her son by God ‑the only difference is that the Muslims do not believe that Jesus is the Son of God.

So, why did Obama say "... Moses, Jesus and Muhammad (peace be unto them) ... ?" Because he had to. And what does it mean? By appeasing the Islamic world, Obama has professed to the World that Jesus is a holy prophet, and is dead, and definitely not the Son of God.

If Obama thinks that the another $1 Trillion Stimulus Package is the answer to fix the US recession, he should heed the warnings of the IMF.

Advising the G20 Leading Nations that stimulus spending without financial sector cleanup is useless, IMF Managing Director Dominique Strauss-Kahn warned,

"Bluntly the situation is dire ... as the crisis spills over into developing countries, millions of people will be pushed back into poverty and hardship. All this will affect dramatically unemployment and beyond unemployment for many countries it will be at the roots of social unrest, some threat to democracy, and may be for some cases it can also end in war."

"You can put in as much stimulus as you want. It will just melt in the sun as snow if at the same time you are not able to have a generally smaller financial sector than before but a healthy financial sector at work," he said.

The IMF proposed solution ... fix the banks & the financial sector.

As stated in "Obama: Confident latest bank rescue plan will work, "Obama is now planning is to buy up the assets that are weighing on banks' balance sheets and are hampering banks' ability to resume more normal lending to consumers and businesses. The drop in lending has worsened and prolonged the recession. The plan seeks to draw in private investors with inducements like billions of dollars in low-interest loans to finance the purchases.

Couldn't this have happened with the first Obama's first "Stimulus Bill" or as titled the American Recovery and Reinvestment Act of 2009 (large file) and saved the US taxpayers trillions?

While the Federal Reserve is creating Trillions of US Dollars which devalues the money we have in our pockets, Obama is making jokes on Jay Leno. While the Treasury Department is hardly even staffed and is allowing corporate bonuses to go through Obama is cracking jokes regarding "mentally and physically disabled people" on Jay Leno.

While the General Accounting Office is claiming "Oops, we were short the budget forcast by 1 Trillion US Dollars," Obama is making his NCAA Final Four predictions for ESPN in the White House War Room. While the US Congress is abusing its taxing power, Obama is throwing White House parties almost every night!

This is the sad fact: the Obama White House Parties on as “Rome” Burns; and nobody cares!

The most unbelievable part is the predicions made by Igor Panarin, a dean at the Foreign Ministry's school for future diplomats and an influential force of Russian President Dmitry Medvedev's policy regarding the United States. Igor Panarin states, "There is a high probability that the collapse of the United States will occur by 2010." He further argues that President Barack Obama will order martial law this year, the U.S. will split into six rump-states before 2011, and Russia and China will become the backbones of a new world order.

Igor Panarin may be wrong about the stability of Russia but can the rest be true? Why the hell not! China is bailing out the United States, the United Nations says the the World should ditch the declining US dollar as its reserve currency and the US Army has already been deployed to a small, south Alabama town.

Is this the end? I hope not .... but all this does seriously lower our image, especially when Obama is doing late night comedy shows. Pigs!

Action News 9 report "Schenectady mayor considers options, martial law over police woes," Schenectady Mayor Brian Stratton said he is seriously considering declaring martial law in order to clean the corruptness in the city. The governor would have to declare it and then the National Guard would come in. The mayor said it's more for a transition to a new police force if that were to happen.

Look how easily our government officials are ready to declare martial law.

Edinburg to Cancel Elections?

As stated in The Monitor's March 17, 2009 article "Edinburg may cancel election after candidates run unopposed," City Secretary Myra Garza said she will soon ask the City Council to cancel the city's May 9 election - which would have forced some employees to work that Saturday - after three candidates for political office ran unopposed.

A deadline to file as a write-in candidate passed Monday, assuring former mayor Richard Garcia and incumbent councilmen Noe Garza and Gus Garcia will return to office when May 10 rolls around.

So what now? Well, here it is ....

City Secretary Myra Garza must certify in writing that a candidate is unopposed for election to an office if, were the election held, only the votes cast for that candidate in the election for that office may be counted.
The certification must be delivered to the City Council as soon as possible after the filing deadlines for placement on the ballot and list of write-in candidates, which already passed.
Upon receipt the City Council may declare each unopposed candidate elected to the office by order or ordinance.
If the declaration is made, then the election is cancelled.
If the election is cancelled, a copy of the order or ordinance shall be posted on election day at each polling place that would have been used in the election.
A certificate of election must be issued to each candidate in the same manner and at the same time as provided for a candidate elected at the election.
The candidate must qualify for the office in the same manner as provided for a candidate elected at the election.

What happens if any of these are not followed? The "election" is void.

Is this clear sailing yet? No. Joe and the E-News rats can still sabotage the election.

Let's keep our fingers crossed and pesticides out to make sure these crooked politicians don't intentionally sabotage the electoral process.

As stated in "Bair Says Insurance Fund Could Be Insolvent This Year," Federal Deposit Insurance Corp. Chairman Sheila Bair said the fund it uses to protect customer deposits at U.S. banks could dry up amid a surge in bank failures.

“A large number” of bank failures may occur through 2010 because of “rapidly deteriorating economic conditions,” Bair said in the letter.

The deposit insurance fund won’t dry up because the government can get funds from the industry and congressional appropriations, and borrow from the Treasury, Chip MacDonald, a partner specializing in financial services at law firm Jones Day, said today in a telephone interview. “As a depositor, I am not worried in the least,” MacDonald said. “No one is going to let the FDIC go without any money.”

As stated in "Geithner Warns of Deeper Slump, Seeking Backing for Bank Rescue," Treasury Secretary Timothy Geithner warned the U.S. recession is worsening. The strength of an economic recovery hinges on the government’s ability to supply financial companies with fresh capital to get credit flowing again, the Treasury chief indicated.

“The first really important thing we do is to make sure that banks have the resources they need to be able to provide credit to the economy,” Geithner said at the Senate Finance Committee hearing yesterday.

Where do we get fresh capital from? Why credit? Credit is imaginary money! That's what got us in trouble in the first place!!! Printing new money will not solve the problem, it will only devalue the money we already have!

But what they fail to see is even though the banks accounts are insured to $250,000, what good is $250,000 of devalued currency? You might as well have 250,000 boxes of Kleenex. If you don't believe that can happen, just remember the Mexican Peso.

Can the US become fall this low? Remember Obama's mantra "Yes we can!" After all, the Dow Jones has fallen over 20% since he has taken office.

As reported in the Friday, February 27, 2009 edition of the San Francisco Chronicle, "U.S. Attorney General Eric Holder is sending strong signals that President Obama - who as a candidate said states should be allowed to make their own rules on medical marijuana - will end raids on pot dispensaries in California."

Several states have passed medical marijuana laws which allow for the growing and the personal use of marijuana for medicinal purposes. The problem was that the federal law prohibited such actions and raided such facilities.

"The president believes that federal resources should not be used to circumvent state laws" and expects his appointees to follow that policy, said White House spokesman Nick Schapiro.

So with all the crap flying around in Washington, here is a dangerous precedent. If a State enacts a law which defies a Federal law, then according to Obama, the State law wins.

"If you removed the obstacles to research," said White House spokesman Nick Schapiro, "in 10 to 15 years, marijuana will be available in pharmacies."

Joining Eddie Saenz is, you guessed it, my favorite clown, Joe-Joe the Clown. We know that Joe has aligned himself with former District Clerk Omar Guerrero but now he takes true for for supporting his long time friend and criminal Eddie Saenz.

We know that Joe and Eddie own some beach property together.

As stated in the September 27, 2007 "Candidate for state representative charged with DWI" article in the Monitor,

An officer stopped Saenz for turning without signaling but then smelled alcohol on Saenz’s breath and noted his speech was slurred, court documents show. The officer also noted that Saenz performed poorly during a field sobriety test and then refused a breath test.

Mission police said he would have been charged and booked that night, but the arresting officer found himself inundated with other calls. Given Saenz’s deep community ties, police considered him a low flight risk and officers let him go.

Would you and I been given such treatment? No. So here's to you Eddie Saenz.

As stated in David Diaz's "Edinburg 'advisory committee' reccommends city tax incentives for buyers of new homes," "Future buyers of new homes in Edinburg might qualify for a break from city property taxes under a plan being promoted by an informal advisory group organized by Mayor Joe Ochoa."

"Proponents of the plan, dubbed the Homebuyers Tax Abatement Incentive, who are part of a group calling itself the "Mayor's Advisory Committee," said the tax break, which would be temporary, would only apply to the value of the home, and not to the value of the lot.

For a newly-constructed home valued at $100,000, Rodríguez illustrated, the city would not collect any city property tax on that structure in the first year, then collect 20 percent the following year, 40 percent in the third year, 60 percent the fourth year, and 80 percent of the fifth year.

Ochoa said he had shared similar sentiments with the group, but emphasized that the advisory council is one way for Edinburg residents to bring their concerns and ideas directly to the city council."

Now, why did Joe-Joe the Clown share similar sentiments ... he runs the meeting.

Why is this a bad idea? First, this advisory group is not sanctioned by the Edinburg City Council and you cannot enter the group with out Joe's approval. Click here to see a proper advisory council. How is this dangerous? Remember Joe's greatest accomplishment, Super Splash? Well, he says it was not his fault. How is it not his fault? He says he was just giving the citizens what they wanted. Who were those citizens ... we don't know, there are no records of the Mayor's Advisory Committee back then either.

Second, the middle classs is already being dumped on by Joe's tax freeze. Now, he wants tax breaks/incentives for new home buyers. Who is going to pay for the police and fire protection, sanitation, roads and other municipal tax burdens? Not the tax freeze recipients! The present citizens and voters of Edinburg. But guess who is going to be exempt? Joe Ochoa will be building his new house pretty soon and Hector Casas owns Shea Construction. Another Joe-idian, Robert Pena Jr., owns DevCon Properties. Rats! They want to get rich with our money!

So what does that mean to you and me? You got it, more taxes.

Included are PSJA ISD Superintendent Arturo Guajardo, PSJA school board Secretary/Treasurer Raul "Roy" Navarro, PSJA school board member Rogelio "Roy" Rodriguez, PSJA school board member Vangie De Leon, De Leon's husband Richard De Leon, and Donna school president George Hernandez.

Further, Arnulfo "Arnie" Oliveraz, an insurance agent, was also arrested.

But wait, there's more! The FBI is not done. They are coming to Edinburg to look at some of the 1997 - 2005 ECISD School Board members and Administration.

The Politics of Hate

For the past many months, Edinburg Mayor Joe-Joe the Clown has led a hate campaign aganst State Rep. Aaron Pena, who runs A Capitol Blog and has helped spearhead RGV interest in probably the most fiscally sucessful session in Texas History.

Joe has spent the past months rallying support to oust House Speaker Tom Craddick not because he hates Tom Craddick, but because he hates Rep. Aaron Pena. As I have told you before, Edinburg does not exist in a vacuum and Joe-Joe the Clown's tricks have an effect on the whole Valley.

This is the reason why I fear his involvement in State Level government. Locally, he is the sole cause of many delays and stalled projects, plus he just wants to see many projects fail or die before development ... solely because they are not his projects. These include, the Edinburg Police Department and the Edinburg Mall.

But what effect may this man's hate have on the rest of the Valley? As stated in the May 27, 2007 "Valley budget-writers say they like budget, but threat of block looms" article in The Monitor, the Rio Grande Valley risks losing over $200 million in state money for valley projects. "It remains to be seen whether the budget will pass before today’s deadline in the House, which is in disarray since chaos broke out Friday when some lawmakers tried to unseat Craddick."

And where does Edinburg News' Mayor Joe stand? Well, (1) Joe hates Rep. Aaron Pena, (2) it was Rep. Aaron Pena who helped bring over $200 million to the RGV, over $10 million to Edinburg alone and (3) in this Rep. Aaron Pena has done more for Edinburg in one year than Joe has done in his whole time as mayor .... roughly a decade.

Because of his envy of Rep. Aaron Pena, Joe is cheering for the filibuster and ousting of Tom Craddick, which may lead to the huge loss of money to Edinburg and the rest of the Rio Grande Valley.

Edinburg’s Stockholm Syndrome

The relationship between the City of Edinburg and its citizens is argumentatively identical to that seen in the Stockholm hijacking. We are in a situation where if you are good to Joe and live by his acceptance, then you are allowed to live and prosper within the City of Edinburg. But if you are against them … well, then you are going to get hit, either economically, politically or in Joe’s Edinburg News Blog.

Here’s the bottom line. If you are a friend of Joe, then “no one gets hurt.”

Let me explain. I could not understand why the citizens of Edinburg voted for Joe while knowing of all the bad he did for the City, such as Calpine, CBL, Eddie Saenz, Edinburg Roadrunners, Glasscock Brewery and Super Splash, and all the kickbacks and favors he did for his friends, Albert Figueroa, David Negrete, Eddie Saenz, Hector Casas, Diamantina Gayton, and Mary Villarreal. Then it shocked me when the citizens of Edinburg voted more of his cronies into office.

So I ask … why do these Joe-idians, not limited to the people mentioned above, keep on defending Joe? Why does this man have so many martyrs and apologists?

Maybe the reason these people end up defending Joe, who overall oppresses them, is because they identify with him on some deep-seeded emotional level, as the person who will take care of everything and all you need to do is just “do what I say.”

Here, Joe makes it very easy for the Joe-idians. Joe will think and act and speak for them, thus relieving them from responsibility. Yup, just like children. You find this kind of relationship prevalent in domestic violence situations and cults (hence, the Joe-idians).

So how do you cure this? Simple, grow up and think for yourself.

If you fear responsibility, then you are willing to give up freedom. However, if you want freedom, then you gain responsibility.

It is just over one year since Joe Ochoa became Mayor of Edinburg and since then we have seen that his rhetoric is mere image over substance. Let me extrapolate.

What has Joe done to make the quality of life in Edinburg easier?

As stated in the May 15, 2007 “Gas and food prices keep climbing” article in the American Public Media website, “Average gas prices hit a record $3.10 a gallon this week and that's not all … It's not just the price at the pump that's hurting consumers.” They go on to say that “Wholesale prices have gone up more than retail [and] food prices are going up as well.”

I bet you’re asking what Joe has to do with this. He is just the Mayor, not the President! Well, let’s look at what Joe did aggravate the situation … Joe raised our taxes. First, there was the “Edinburg tax increase” followed by the “Edinburg tax freeze” which, respectively, raised the property taxes then froze the taxes for the disabled and elderly thereby shifting that burden to the rest of citizens of Edinburg.

Gas prices are up. Food prices are up. Wholesale prices are up. Property taxes are up. Disabled and Elderly taxes are shifted, which means more taxes. And what are the positive things he has done? Joe spends Edinburg tax dollars to praise his own son and he spends more Edinburg taxes to hold a prayer breakfast at his buddy’s business.

What has Joe not done to make the quality of life in Edinburg easier?

He still has not even begun to work on the Edinburg Police Department nor has he implemented his “$3.5 million plan within the next 30-60 days” of his September 19, 2006 Action 4 News appearance claiming a solution to the sewage problem to the Freddy/Sugar intersection.

Stalled city hall. Stalled Police Department. Stalled repairs on the sewage problems. Stalled construction on the new mall in Edinburg. Still no action on the building right next to the new city hall, which was supposed to be the city hall. (Yes, Joe paid David Negrete hundreds of thousands of dollars for that one!)

So my thanks to Joe, because of you I work harder to get less. Maybe I should be your friend, and then you would throw Edinburg tax dollars at me.

On May 21, 2007, (two days after my post ... suspicious) Team 4 News report "Gas prices kill the budget," states, "The average $3.09 at the gas pump that we've been seeing has been killing the pocket book!! But for some,the high gas prices means much more." Furthermore, "We can count on price increases on everything from flowers to airlines tickets."

Thanks again Joe ... want to raise my taxes again ... maybe your son needs a new suit for work!

Just recently, Edinburg News released a post saying that "the recall on Gene Espinoza was very real. We just decided to drop it cause of the 75% of the vote that was needed to recall him."

The picture on the left shows the disclaimer "Paid by the Informed Citizens of Edinburg."

So who are the Informed Citizens of Edinburg? Remember what was revealed in "What is a "Taco" Voter?"

On May 3 and 5, 2006, a negative advertisement was placed against Omar Palacios, with the disclaimer as “Pol. Ad paid by Informed Citizens of Edinburg, P.O. Box 178, Pharr TX 78577.” However, James R. Gray, Publisher of the Edinburg Review, verified that the person who paid the ad was Gilbert Mercado, III.

On May 5, 2006, a negative advertisement was placed against Richard Garcia, this time with the disclaimer as “Paid by Informed Citizens of Edinburg, P.O. Box 178, Pharr TX 78577.” However, James R. Gray, Publisher of the Edinburg Review, verified that the person who paid the ad was Joe Ochoa.

Therefore, the recall for Mayor Pro-Temp Gene Espinoza was spearheaded by Edinburg Mayor Joe Ochoa and ECISD Trustee-wannabe Gilbert Mercado, III. The "we" in the "We just decided to drop it" refers to Edinburg Mayor Joe Ochoa and ECISD Trustee-wannabe Gilbert Mercado, III.

Word to Robert Pena Jr. .... be careful with your deal with Steve ******. I know your campaign promise and I know what you're trying to do. Your deal is already set up and you will be the scape goat .... again.

Note to The Monitor and The Paper of South Texas, do an open records request for the credit cards at the EEDC when Robert Pena was the EEDC director and see the "gifts" he was buying on the taxpayer dime. In that, you will also find how Joe Ochoa covered it up.

Finanacial troubles for Robert Pena Jr.

Yes, the big scandal of the day was the towing of Robert Pena Jr.'s truck while at the ECISD Administration building. Robert Pena Jr. and his Edinburg News site have stated that it was "just mechanical problems," therefore they had to hire a tow-truck to take it to a garage.

Funny thing is the tow-truck was from an Auto Recovery company from Harlingen, Texas. Why did Robert Pena Jr. need to call a tow-truck out of Harlingen? Answer: Maybe all the ones in Edinburg and McAllen were busy. Or maybe it was reposession.

But if you doubt that Robert Pena Jr. is financially stable, then chew on this.

In Cause # CL-06-3490-B, Carlos Mir vs. Robert Pena Jr., Individually and DBA Development Consultants and Devcon Properties Ltd. Here's the summary:

Carlos Mir alleges that Robert Pena Jr. and Carlos Mir became partners in Development Consultants in which Carlos Mir invested fifty six thousand dollars in lots that were purchased with all or part of Carlos Mir’s money.

Homes were to be built on the lots and it was further agreed between Carlos Mir and Robert Pena Jr., that from the sales proceeds, Carlos Mir would receive not only an accounting, but also all of Carlos Mir’s money back and one-half of the net profits of the construction projects.

Robert Pena Jr. paid Carlos Mir back only ten thousand dollars. Robert Pena Jr. continues to buy lots, construct homes on the lots, and is selling the lots with the homes. Robert Pena Jr. also call his business Devcon Properties Ltd.

Questions:

If Robert Pena Jr. can't pay back his business partner, what makes us believe that he will be honest with our tax dollars?

If Robert Pena Jr. lies to his business partner, with the financial records, then how will be accountable with our tax dollars?

If Robert Pena Jr. can't pay back his business partner, how is he expected to pay his truck?

If Robert Pena Jr. is already involved in this shady business dealing, as well as the EEDC money scam, then maybe these next cases are his too.

ECISD Board Member David Torres "says someone threatened to burn down his business in connection with a controversial athletic department reassignment." David Torres went on to say, "I think this is just outrageous," adding he is worried for his wife, children and employees. "I think it is the lowest form of politics, or whatever you want to call it."

I thought all night and day who could be behind the act and I could only come up with one answer. Robert Pena Jr. and his Edinburg News site have attacked Melba Gonzalez, Carmen Gonzalez and now David Torres. So now, who is next? Not Greg Garcia or Jaime Chavana, they support Robert Pena Jr.

As stated in the April 30, 2007 "School Board Member Being Threatened" NewsChannel 5 report, David Torres says the threat is "directed at a decision made by our superintendent about the athletic director and ... he supports the superintendent's decision. He adds he's not scared by the threats and he's not backing down."

As stated in the April 30, 2007 "Edinburg School Trustee Threatened With Note, Gasoline" Team 4 News report, Irene Mercado, an Edinburg resident, mother of twice unsucessful ECISD candidate Gilbert Mercado, stated "That's very serious when you threaten somebody like that ... [but] I don't think it's anything that has anything to do with the elections -- something personal probably." Can't the woman read? Even Mario Lopez and Robert Alaniz say its political.

I think its interesting how Team 4 News found Irene Mercado to do the sole interview. I wonder which connection they have ... **cough** Joe **cough**.

Give me some Election Protection ... again

With all the back biting and everyone trying to screw eachother over, this plot should be part of an after-dark movie rather than the ECISD election. Ok, here it is and I will not say it again.

Who was wrong? Everyone ... Melba Gonzalez, Mario Lopez and Robert Pena Jr. Who stayed right? Carmen Gonzalez. Let me expound.

Let's start with Robert Pena Jr. & Carmen Gonzalez.

As we have seen in a previous blog "Robert Pena Jr. is one of the rats from Edinburg News," Robert Pena Jr. and his Edinburg News site is the one who posted information regarding a Class C Misdemeanor against Carmen Gonzalez. If you don't know, a Class C Misdemeanor equates to a parking ticket or in this case ... an argument. How is Robert Pena Jr. wrong? Stating the obvious, he is running a smear campaign under Edinburg News, itself a violation of Texas Election Code § 258.004.

Carmen Gonzalez has gracefully turned the other cheek.

Next let's talk about Melba Gonzalez & Mario Lopez.

Melba Gonzalez, while on the Edinburg CISD Board, made a highly inappropriate statement/suggestion/threat to Mario Lopez regarding his wife. That is against her Board Member Code of Ethics; however, the violation was about 2 years ago. To punish Melba Gonzalez for her conduct, the public may either (1) vote her off or (2) file a petition to a District Judge.

Mario Lopez sat on a recording for two years until he could use it to his advantage. He should have brought this out back then, through the appropriate channels. Further, he used coercive means in order to influence Melba Gonzalez's decision to give him and his wife favorable contracts. Evenmore, Mario Lopez should have also reported his DWI to the ECISD. These actions are against his Educator Code of Ethics. To punish Mario Lopez for his conduct, the ECISD may take discplinary action, including termination of employment.

Now let's move to Melba Gonzalez & Robert Pena Jr.

Back to the tape. Who released the tape ... easy ... Mario Lopez. But who encouraged Mario Lopez to release the tape and planned for the release? Robert Pena Jr. Yup, in his Edinburg News site, Robert said he was "sitting on a gold mine" and called for the release of the tape to Channel 4 News since March 10, 2007. This was not a new development.

On March 9, 2007, Robert Pena Jr., in his Edinburg News site, stated,

This just in Jesusa Ramirez, Melba Gonzalez's sister makes 66,215.00 a yr. We are in the process of getting a recording that took place between Melba Gonzalez and an administrator. In reference to her sister Jesusa. Stay tuned!

So far, Melba Gonzalez has not brought up any of Robert Pena Jr.'s past at the EEDC.

My Opinion.

Who is it we are looking for, Melba Gonzalez or Robert Pena Jr.? First we have a Board Member getting upset and making threats then we have a manwho is conniving and childish even before entering office. I will cast my vote for the former because she was acting human and not for the man who was caught with his hand in the cookie jar ... again (first at the EEDC - misappropriation of funds). You choose who you want.

What should happen to Mario Lopez? All politics aside, he should be terminated. No man like this should be trusted in the Education of our children ... teaching them to lie in wait or to be maliciously opportunistic, nor should any other employee of the ECISD trust him.

What should happen to Carmen Gonzalez? Well, she has taken the high road. We need more people like this.

A little light on Sandra Lopez

Robert Pena Jr. and the rest of the rats at Edinburg News want you to think that Mario Lopez and Sandra Lopez are innocent people in this election. However nothing could be farther than the truth. This next blog just goes to show how decietfully close Robert Pena Jr is to the Joe-idians and thier "win-at-any-cost" and "screw-them-when-you're-in" political style.

Do you remember Eduardo Mendoza vs. Edinburg CISD and Sandra Lopez, Cause No. C-389-06-B. Wait ... is that the same Sandra Lopez as in Mario Lopez's wife? Yes it is.

Facts stated in the Original Petition of Cause No. C-389-06-B: Eduardo Mendoza sued the ECISD and Sandra Lopez becuase he was placed on suspension after he reported that he was being sexually harassed by Sandra Lopez. Eduardo Mendoza went on to claim that Sandra Lopez then filed false complaints against him after he blew the whistle on the sexual harassment.

Eduardo Mendoza also stated that Sandra Lopez also gave him "personal gifts." I wonder if her ... stand-by-his-wife ... husband, Mario Lopez knew about those gifts.

Here's the kicker ... when Eduardo Mendoza blew the whistle, he was suspended and Sandra Lopez was allowed to keep her job because she was, Mario Lopez's wife.

As stated in "Typical SuperSplash Ochoa & "Hot Checks" Mercado"

Oh ... oh ... Gilbert, you're not trying to decieve the voters, are you? I checked you out. Nice ad placed in the Edinburg Daily Review ... "ECISD Lawsuit" disclaimed as "Pol. Ad paid by Informed Citizens of Edinburg, P.O. Box 178, Pharr TX 78577." However, James R. Gray, Publisher, verified that the person who paid the ad was ... [drumroll] ... Gilbert Mercado, III.

This case was filed and settled only to get Eduardo Mendoza's job back.

In this case, this was an instance where J.L. Salinas, Gilbert Enriquez, Jaime Chavana & Greg Garcia ... tried to sweep this one under the rug, like Bernabe "Peeping Tom" Reyna Jr. and Mario Lopez's DWI?

The nerve of these people. Remember the saying, this is the pot calling the kettle ... black. Well. this is a case of the pot calling the nickle ... black.

Ok. This is what I recieved, by way of earnmyvote@hotmail.com. Remember that fax from the SPI Police Department that was posted on Edinburg News site? Yup, the recipent was scratched off. Well, here's the scoop.

Robert Pena, who is running against Melba Gonzalez for ECISD School Board, has been a bad boy. He is running a smear campaign a-la Joe Ochoa & Gilbert Mercado style. He is absolutely linked to Edinburg News and its smear site. How do I know? Simple.

Edinburg News promised a posting about Carmen Gonzalez accusing her of attempted murder. Well, the idiots posted the fax from the police department. A simple freedom of information request turned up the name Mitch Garcia and the fax number (956) 318-1071 as the requesting party.

Well, what do you know. A Google search of (956) 318-1071 returns the name Robert Pena, Jr. of 4622 South Business 281, Edinburg, TX and the email address of robjrpena@aol.com.

As stated in EdinburgPolitics.com, "Robert Peña, Jr. bringing proven track record of successes in bid for ECISD Place 4 trustee slot" lists Robert Pena, Jr.'s business as Development Consultants and Construction which is 4622 South Business 281, Edinburg, TX.

Look at the Texas State Bank 2nd Lien Deed of Trust, it states the same information.

So what does that mean? Robert Pena, Jr. is definately a contributor, if not an author, of Edinburg News.

Remember, Texas Election Code § 258.004. Fair Campaign Practices Act, (2) I will not use or permit the use of character defamation, whispering campaigns, libel, slander, or scurrilous attacks on any candidate or the candidate's personal or family life.

Robert Pena ... integrity? I don't think so. Robert Pena Jr. ... crooked and corrupt, definitely.

For those of you who may have slept early last night ... here's a recap.

<--- This guy, ECISD employee Mario Lopez, saved a recording of Melba Gonzalez for two years to use as his golden ticket. Mario Lopez is claiming that ECISD School Board President made good on a "threat" to demote his wife, Sandra Lopez. As stated in the April 23, 2007 "School Board President caught on tape" Team 4 News report, the recording "[reveals] what appears to be the ugly side of threats and favors in the Edinburg school district political arena." The problem is that "[Mario] Lopez s wife, Sandra [Lopez,] would harass [Melba Gonzalez's] disabled sister in the district warehouse where they both worked."

For his five minutes of fame on Team 4 News, Mario Lopez should be revealed on the other side of the scandal.

Remember the saying, People who live in glass houses should not throw stones .... well this is Mario Lopez.

Why is there a mug shot of him? Try this one on for size. How about the confinement on 01/10/2003 at 09:23pm for Driving While Intoxicated.

As profound as the loss of a brother is to anyone, the death on Wednesday, April 18, of Alejandro Ochoa, Sr. of Edinburg marked a solemn day for his surviving brother, Mayor Joe Ochoa, who said he lost his mentor and father-figure as well.

My condolences to Mayor Ochoa and his family.

However, the major event in Edinburg, regarding the City of Edinburg and the state of Edinburg Politics, was the opening of the highly anticipated and controversial Dustin Michael Sekula Memorial Library.

As stated in EdinburgPolitics.com, "Mayor Joe Ochoa and the City of Edinburg proclaimed Thursday, May 3, as National Day of Prayer (NDP). As part of the NDP, the Edinburg Chamber of Commerce is inviting the community to join the mayor for a prayer breakfast to be held at The Social Club, located on 205 Conquest Blvd in Edinburg."

According to the Hidalgo County Apprasial District, The Social Club is owned by Account # 00001447, Shea Ltd ... or Hector Casas. Yup the funny looking, slightly obese guy in the orange shirt.

The City of Edinburg has several activity centers, a city auditorium and the usual conference center ... The Echo Hotel, but Joe-Joe chose to give a blatant kick back to his cronie, Hector Casas.

More information is available through the Edinburg Chamber of Commerce at (956) 383-4974. Call the chamber and let them know you are outraged for allowing Joe-Joe to make such a blatant kickback. If you are afraid of retaliation ... just press *67 before you call.

Peeping tom in Edinburg

As stated in the April 11, 2007 "Alleged Peeping Tom Arrested" Team 4 News report, "Hidalgo County Sheriff investigators are charging a county worker for peeping into the ladies restroom at the courthouse."

Bernabe Reyna Jr. was arrested pursuant to a warrant for disorderly conduct. Hidalgo County employees believe Reyna should be fired. "I think he should be let go, because, I mean, if he can do it here, he can do it somewhere else."

JD Salinas for now is recommending also Bernabe Reyna is let go from his job, but will follow procedures by the Human Resources Department.

Warrant description: Hispanic male, 5' 11", Brown Hair, Brown Eyes, Huge Smile on his face.

As stated in the April 12, 2007 "Accused Peeping Tom Caught Before" NewsChannel 5 report, "We've learned Bernabe Reyna was fired from an Edinburg school a few years ago, after girls caught him looking at them in the bathroom stalls. They say Reyna actually crawled under the stalls."

"The girls at B. L. Garza Middle School reported him to administrators. The Edinburg school district says after an investigation, Reyna was fired. Our research shows Reyna has no criminal record. No charges were filed after the peeking report at the school, so nothing would have turned up in a background check."

Um ... J.L. Salinas, Gilbert Enriquez, Jaime Chavana & Greg Garcia ... did you all try to sweep this one under the rug?

Joe-Joe ... worried about business

Joe-Joe the Clown, like many other "local independent pharmacists reacted to news of a new prescription drug discount card slated to make its debut in Hidalgo County," as stated in the April 4, 2007 "Prescription drug card draws fire from local independent pharmacists" article in The Monitor.

"The card would allow an average 20 percent savings on prescription drugs to all Hidalgo County residents who are uninsured or underinsured." But here, we have already seen, previously in "Why isn't our weak mayor fighting for the mall?"

First, it was not Joe's project, so he wants to see it fail. Second, the mall was to contain CVS Pharmacy, which would surely have spelled the end to Joe-Joe's mom & pop shop pharmacy. The City of Edinburg has a lot to lose if this mall does not go through and Joe just doesn't care.

Now, with the benefit of the prescription drug discount card to all the elderly, uninsured or underinsured, Joe-Joe is more worried about himself that the people he serves.

"The card is accepted at more than 57,000 independent and chain pharmacies nationwide. Nearly 700 counties across the United States use the card, including 40 in Texas." But Joe-Joe does not want it here, not for us.

So, Edinburg, keep a close eye on Joe. It won't be long until he gets desparate and his shady deals become blatant deals.

But what was not told by the puff piece was that Robert Pena Jr. was forced to resign because he was making personal puchases for gifts from the EEDC account.

Now, Robert "wants to apply the knowledge [he] gained" in the Edinburg School District. Yeah, in other words, we want more of your money.

Like Robert assured, Edinburg would be "electing an independent voice with leadership qualities." But then again, the only "proven record" Robert is bringing is that he is an Ochoa-puppet with a questionable moral turpitude history.

As stated in the March 19, 2007 "Edinburg close to resuscitating police building" article in The Monitor, "The City Council will likely agree to a bond settlement on the mishandled police department project Tuesday night."

"Contractor Velasco Construction’s bond company, Zurich, is ready to pony up after months of investigation into why Velasco walked away from the project last April. The contractor claims a slow stream of directions from the architect made steady construction impossible."

"Negrete denies any fault and will continue on as the architect with whichever contractor is hired to carry out the project’s remainder, Rios said. Hopefully a new contractor will be able to get along with project architect David Negrete, who Velasco cited as the reason for bailing on the project."

Hopefully so. Remember, as I stated in "David Negrete off the hook with your money ... Thanks Joe" Joe-Joe the Clown was able to blame Velaso Construction while allowing his college cronie, David Negrete, to walk blameless and keep all his prepaid money.

On the March 6, 2007 meeting, which was aired at 10:30 p.m. on Channel 12, something interesting happened. The evaluation of City Attorney Dan Rios was discussed in executive session, but the results and a summary of the contents of the executive session was discussed in the public forum.

As the council reconvened out of executive session, Joe-Joe the Clown makes the following comment.

Just to information of the public ... This was just a, I think, a very positive evaluation of Dan Rios.

Here is the problem ... as stated in the Texas Government Code § 551.074, evaluations and personnel matters are entitled to be exempt from public session.

Under the Texas Government Code § 551.145, the recording of the executive session is made to ensure that no matter required to be discussed in public is discussed in private. Yet, the Texas Government Code § 551.146 states that "an individual ... that without lawful authority knowingly discloses to a member of the public the certified agenda or tape recording of a meeting that was lawfully closed to the public ... commits a Class B misdemeanor." Only a court, after a petition for suit alleging an Open Meetings violation, can order the recordings (specifics) of the closed session be released.

However, as stated in the Attorney General Opinion JM-1071, no person in attendance in closed session are prohibited from discussing the subject matter of the closed session. The key word is "subject matter."

Here, the subject matter is that which is already posted onto the City of Edinburg, March 6, 2007 agenda. Therefore, the persons in attendance are allowed to discuss the subject matter to the public, but the details or the summary of discussion is what is specifically privileged and can only be revealed by court order.

The proper procedure should have been a private evaluation and then a public notice and public vote to continue the employment of City Attorney Dan Rios.

If this goes untouched, then this creates a slippery slope. Then, any councilmember can disclose the contents of the closed session, as long as there is no writing or tape recording. Therefore, one council member can say "Mayor said this" and mayor can say "Councilmember said this." Then why even have a closed session!

Joe-Joe, you broke the law again ... a Class B misdemeanor ... just like Omar Guerrero's marijuana charge.

In a recent ad by Joe Ochoa, he stated that he would do what Mayor Garcia couldn’t: complete the police department project. I bet he could.
After all, it is his long time friend, who was prepaid by the Ochoa administration, who is stalling the project.

I humbly say, I was wrong. I gave Joe-Joe the benefit of the doubt that he could finish the project.

In a rush to get Omar Guerrero out of jail, his attorneys for got to file a writ for both of his charges.

As stated in the February 22, 2007 "Omar Guerrero could post bond Monday, attorney says" article in The Monitor,

Judge Noé Gonzalez only granted bond on one of the two charges Guerrero faces in connection with an ongoing sexual relationship police believe he had with a 15-year-old Mission girl.
In legal documents submitted to the 370th state District Court, Guerrero’s attorneys only requested a bond hearing on a charge of aggravated sexual assault of a minor. He also faces a retaliation charge for allegedly threatening to kill the teenager and her mother if either ever told police.

So, when will this all end? Well ... let's see if Cameron County picks up charges against him.

But here is a new update! In the 398th District Court, Omar Guerrero has filed a Writ of Habeas Corpus in cause number C-439-07-I. He wants to get out of jail.

What is a Writ of Habeas Corpus? A writ of habeas corpus is a legal document that forces law enforcement authorities to produce a prisoner they are holding and to legally justify his or her confinement.

What does it mean here? Omar Guerrero is complaining that he is being illegally held without a chance to post bond. He is saying that the bond is used to oppress his liberty because he is not a flight risk nor is he a danger to the girl he molested.

The rules for fixing bond are set in the Texas Code of Crimial Procedure Art. 17.15.

The bail shall be sufficiently high to give reasonable assurance that the undertaking will be complied with.
The power to require bail is not to be so used as to make it an instrument of oppression.
The nature of the offense and the circumstances under which it was committed are to be considered.
The ability to make bail is to be regarded, and proof may be taken upon this point.
The future safety of a victim of the alleged offense and the community shall be considered.

As stated in the February 19, 2007 NewsChannel 4 "Bond Denied for Omar Guerrero" news report,

A Mission judge has denied bond for Omar Guerrero after he was formally charged with sexual assault and retaliation. As expected a Mission judge deemed Omar Guerrero a flight risk and denied bond on two charges.

In a more surprising statement, the F.B.I. went on to say that "Omar [Guerrero] was expelled from Mexico instead of being extradited, simply because he was a person they didn't want in their country."

Not yet .... but at least Joe Ochoa's Running Mate has been caught.

As stated in February 19, 2007 "Under our Noses" article in the Monitor, "Omar Guerrero managed to escape again Sunday night — if only for an hour complaining of chest pains." Omar even "argued that he could not be extradited to the United States because he was a Mexican citizen."

Details ...

[O]fficials say that Guerrero took the teen to parties, exposed her to alcohol and drugs, and had sex with her at several hotels in Mission, Sharyland and South Padre Island.
The criminal complaint that led to an extradition order for Guerrero states that he told the girl from the beginning of their relationship that he would kill her family if she ever told anyone about it.
He allegedly repeated those threats on Dec. 5 when the girl’s mother found out about their relationship and threatened to tell police. Authorities were looking for him the next day.

Now the fun begins, let's see how Omar Guerrero's March 2006 Running Mates react.

Seems that Robert Pena has gotten off to a slow start. Have you seen his signs? They violate the election penal code. Meaning they have no disclosure on the bottom saying political ad paid by candidate. This is what happens when you have idiots running your campaign.

Evenmore as stated in Boss Ochoa, Joe even went as far as to publish for ads listed as Informed Citizens of Edinburg are paid by Joe Ochoa and Gilbert Mercado, themselves - which is a violation of Texas Election Code § 255.005.

Joe won because of kickbacks and campaign promises and most of all campaign lies.

After pro-Sadaam Ochoa websites bash State Representative Aron Pena and his foresight to support House Speaker Tom Craddick, now RGV city delagates have been making trips to Austin with their wish lists.

As stated in the February 09, 2007 "Edinburg shakes Capitol, presents wish list" article in The Monitor, "The local leaders got up close with lawmakers, including meeting with House Speaker Tom Craddick, said Edinburg Mayor Joe Ochoa."

It is ridiculous that Joe-Joe the Clown and his pro-Sadaam Ochoa websites demonize State Representative Aron Pena and House Speaker Tom Craddick, then "[ask] Craddick to help secure $5 million over the next two years." Don't get me wrong, I'm not saying that the money is not needed, because it will be greatly appreciated.

Yet, the trips or "city-paid vacations" are not without scrutiny. As stated in the article,

"Some leaders have questioned whether it is practical to have so many visits from the Valley, many making similar or identical requests. Each has asked the Legislature to fund highways to the Valley, help with economic development and avoid passing anti-immigration bills."

So, the question is ... Which cities do our state leaders funnel the limited state funds? Hopefully Edinburg. But if House Speaker Tom Craddick saw what Joe-Joe the Clown and his pro-Sadaam Ochoa websites have been saying about him ... well ... politics is politics and Joe could very well endanger any future funding for the City of Edinburg.

That, my friends is the difference between a politician and a statesman.

Why isn't our weak mayor fighting for the mall?

Reported on February 05, 2007 in the "Macy's: No plans made for Edinburg" article in The Monitor,

"Unfortunately, Macy’s has indicated that they are not going to locate the planned store in Edinburg while under the constraint of the Simon Property Group-imposed restriction," said David Calvillo, an attorney for the Edinburg mall’s developer, First Hartford Corp. of Manchester, Conn.

The suit claims Simon used "mafia-style tactics" to block any Macy’s from going up within eight miles of La Plaza.

Wow. It took the progressive leadership of former Mayor Richard Garica to take on the Goliath, Simon Property Group, owners of La Plaza Mall and Rio Grande Valley Premium Outlet Mall. However, since Joe-Joe the Clown has come into office, Simon Property has bent Joe-Joe over and has had its way with the City of Edinburg.

This has been reported before on November 14, 2006 in the "Lawsuit: La Plaza choked competitor" article in The Monitor states, "First Hartford ... claims that Simon used "mafia-style tactics" to discourage an unknown number of retailers from signing on to the Edinburg project.

As stated in May 15, 2006 EdinburgPolitics.com's "Planned shopping center in Edinburg one of largest projects for national firm,"

"Our efforts to aggressively market Edinburg and all this city has to offer is really paying off," said Mayor Richard García, who also serves as president of the five-member EEDC board of directors.
"We worked very hard to establish ourselves as a preferred residential community. As a result, the city of Edinburg is well on its way to becoming a major retail destination," the mayor contended. [Mayor Richard] Garcia's term in office, and on the EEDC board of directors, ends on Tuesday, May 16, when newly-elected Mayor Joe Ochoa succeeds him.

Since then and through the whole ordeal, Joe-Joe the Clown has been silent. Simon Property, seeing a weak mayor in Edinburg, decided to use bullying tactics to scare business away from the upcoming Edinburg Mall. And Joe-Joe is all too willing to roll over and play dead.

But why? First, it was not Joe's project, so he wants to see it fail. Second, the mall was to contain CVS Pharmacy, which would surely have spelled the end to Joe-Joe's mom & pop shop pharmacy.

The City of Edinburg has a lot to lose if this mall does not go through and Joe just doesn't care.

One Step Forward, Two Steps Back

Has anybody noticed the potholes in the city's streets? It seems like since Joe-Joe has come into office the city has been going to pot. Pun intended ... right, Joe? I digress.

As stated in the January 25, 2007 "Potholes Causes Expensive Damage" NewsChannel 5 report, "Potholes are causing drivers time and money." Brownsville, we know how you feel. Driving down Sugar, Freddy, Canton and other numerous roads in the city, I have noticed many large pot holes in the streets ... some are deep enough to damage tires and probably even vehicles. My guess ... Joe-Joe will pass the blame. Regardless, with the City of Edinburg 10K coming up, I hope no runner sprains an ankle in one of our All American City Potholes.

Yesterday, I also noticed the manhole on Canton Rd. and Sugar Rd. was overflowing again. Remember as I stated on the September 18, 2006 "Something Stinks in Edinburg" blog, I stated

At 5:55 p.m. I was driving by the Canton and Sugar intersection to check out if anything had been done. And look what I saw ... Joe-Joe the Clown as being interviewed by Action 4 News in response to yesterday's newsreport.

All words and no substance. Here we are over four months later and still no progress. To all of Joe's lemmings ... why are you not complaining about this? Answer ... you just don't care.

What kind of games is Joe-Joe the Clown playing? Does this man think that this is all a game? Let me elaborate.

As stated in the January 18, 2007 “Residents’ voices win out in Edinburg rezone request” article in The Monitor, It was, “democracy in action,” said Saddam Ochoa.

“Residents’ opposition to the Edinburg Economic Development Corp.’s plan to change a 56-acre field off West Palm Drive from an urban-residential zone to a general industrial zone is what ultimately prevented its approval. [Saddam] Ochoa and Councilman Gus Garcia were the only two who voted against the proposal.”

So what’s the problem …

Joe-Joe the Clown, who also sits on the Edinburg Economic Development Corporation (EEDC), not only voted for the plan recommended by the EEDC, he also voted for the spending of over $100,000 to engineer the area and buy more land.

In his desperate attempt to discredit the Former Edinburg Mayor Richard Garcia and the other members of the EEDC, Joe-Joe is playing games with our tax dollars to make himself a Robin Hood.

Note to Joe-Joe: The only thing you and Robin Hood have in common is the color green. Both Robin Hood and Leprechauns wear green outfits.

Well, well, well. It took until Laura Hinojosa to enter the District Clerk's office to see an order from County Court #1 Judge Rudy Gonzalez to enter the system. Congratulations to Judge Gonzalez for making the correct decision.

On November 11, 2006 Judge Gonzalez denied Omar Guerrero's Motion to Suppress. So what does that mean? That means Omar will go to trial for CR-06-885-A, Driving While Intoxicated and CR-06-2089-A, Possession of Marijuana.

Anyhow, we shall see if Omar shows to County Court #1 CR-06-13457-A, Assault Causing Bodily Injury, Family Violence arraignment date on January 12, 2007 or his County Court #2 F-2793-06-2, Divorce on January 22, 2007.

Sadly, strong Omar Guerrero supporter, Joe-Joe Ochoa and his political spin blog state,

"I kind of think this is some kind of publicity stunt. ... Maybe your looking for a hand-out. Or maybe you feel lonely. ... 2007 is going to be a great year. Let's start off with a BANG!"

The Houston Chronicle "Hard-to-find clerk now a wanted man" newspaper article portray's Omar Guerrero as "a former plumber with a high school diploma." Attorney Al Alvarez, said the police reward is ''ridiculous." "He's an innocent man, and he's been wrongly accused," Alvarez said. Attorney Al Alvarez said his client is out of town, not hiding.

''He had a golden tongue, and he fooled the people," said one elected official who asked not to be identified. ''This boy can talk your shirt off your back."

As stated in the December 9, 2006 "Lawyer: Guerrero will be arrested next week" article in the Monitor, Al Alvarez, Guerrero’s lawyer, said the 29-year-old district clerk could be arrested as early as Monday. "My best guess is Monday, but we haven’t worked out the details yet," Alvarez said.

Alvarez said his client is out of town and did not know about the charges until Thursday.

Back in the Houston Chronicle article, Alvarez said of the sex charges, ''At this point, it's a mere allegation. People make these allegations all the time, and we have to give him the benefit of the doubt." Those familiar with the charges say they stem from a consensual relationship with a Mission teenager.

Hidalgo County District Clerk Omar Guerrero now is finding himself in deeper holes than he already was. How much uglier can this get?

At this time, I am investigating claims of retaliation towards the family of the 15-year old girl. News is still fresh, but incredible.

As stated in the December 07, 2006 NewsChannel 5 report "Search for District Clerk Continues," "Officers also raided the district clerk's McAllen home. They say they found marijuana and cocaine but not [Omar] Guerrero. Detectives say they received a tip about a broken gate and window, which lead them to believe he could be here."

According to December 07, 2006 Team 4 News report "Attorney: Omar Guerrero Expected to Surrender," Attorney Al Alvarez says [Omar] Guerrero is out of town, but should turn himself in to authorities on Friday. Alvarez also represents Omar Guerrero in his DWI and Possession of Marijuana charges, which are awaiting rulings on Motions to Suppress in County Court at Law #1.

As stated in the December 06, 2006 NewsChannel 5 report "Arrest Warrant Issued for Hidalgo County District Clerk," Hidalgo County District Clerk Omar Guerrero is wanted in connection with the aggravated sexual assault of a 15-year-old girl.

Texas Penal Code § 22.021, Aggravated Sexual Assault is a First Degree Felony and carries the possible punishment of 5-99 years in prison.

If Omar Guerrero enters a plea or is convicted, his picture and information will not only be posted on this blogsite, but other websites as well ... such as the Texas DPS Sex Offender Registration Database Website.

Recent rumors of a pending warrant from Mission which were previously unsubstantiatied have now been revealed. Since Omar is notorious for not showing up at work, police went to Omar Guerrero's home to arrest him with no luck. What now? When is any elected official going to ask for this man's resignation?

Omar Guerrero can only be removed in limited circumstances, as stated in Texas Local Government Code § 87.013.

Congratulations to Carlyn Mitchell, who in the December 04, 2006 "Mix of society’s elite, less-heard voices puts local political blog scene on track with national trend" newpaper in The Monitor, got it right. There is a power of that lies with a good blogger. The article talks about State Rep. Aaron Pena's site, Shaine Mata's sites, Edinburg Councilman Gene Espinoza's site, Edinburg Councilman Gus Garcia's site and yours truly.

As stated in The Monitor, "the top dog in the Edinburg blogosphere is undoubtedly 'Earn My Vote' — whose identity vexes his or her cyber-enemies as much as fans who simply refer to said individual as 'Earn.'"

The article even points out to the clothing line on CafePress.com. "Earn" has even created a clothing line on CafePress.com, selling T-shirts and women’s thongs printed with his handle. The phrase, "I am Earn My Vote," is also available, demonstrating "Earn’s" fun with the web-community’s fascination with the blog.

Mark Tremayne, a journalism professor at the University of Texas at Austin, says "many national influential bloggers who engage in actual reporting rather than opinion writing — which fuels the largest percentage of blogs — get hired on by the mainstream media, the credibility of which cannot afford to get scooped."

As stated in Section VIII. Awarding of Bids/Contracts/Resolutions, Subsection F and I on the City of Edinburg's agenda for November 21, 2006, the city of Edinburg is looking to hire attorneys.

Subsection F. "Consider Authorizing Interim City Manager to Negotiate and Enter Into a Professional Services Agreement for Collection of Delinquent Court Costs, Fines and Fees."

Subsection I. "... Retaining Counsel to Represent the City" possibly against AEP.

As I mentioned earlier, on the City of Edinburg's agenda for November 8, 2006, an item of interest is in Section IX Awarding of Bids/Contracts/Resolutions, Subsection I - Consider proposal of Bond Counsel Services .... I wonder if Joe-Joe is trying to bring in one of his lawyer buddies into this one. Political favor, hummmm? We shall see.

Today ... that gives three opportunities for for Joe-Joe to fulfill his campaign promises. To counter that, I encourage all attorneys in Edinburg to give the interim City Manager a call for an interview or send letters of qualifications.

As stated in the November 15, 2006 "County seeks DA’s opinion on contract," article in the Monitor, "Last week, [Hidlago County Judge Ramon] Garcia repeatedly asked the Linebarger, Goggan, Blair & Sampson representative to lower a proposed 20-percent collection fee to 15 percent." So what's the problem ....

Start with this. "Linebarger did not indicate in writing how much it would charge delinquent taxpayers, although a representative told the commissioners they would charge 20 percent." Therefore there was a defect-omission in the bid. As stated in Texas Local Government Code § 271.026, "A bid that has been opened may not be changed for the purpose of correcting an error in the bid price."

Further, as stated in Texas Local Government Code § 271.0245,

"[The] governing body of the governmental entity shall provide all bidders with the opportunity to bid on the same items on equal terms and have bids judged according to the same standards as set forth in the specifications."

However, I feel the more important question is part (b), which states "A governmental entity shall receive bids under this subchapter in a fair and confidential manner."

As asked in the Monitor, "[Does] the omission [of the collection fee] on the paperwork invalidates Linebarger’s bid? If not, did Garcia’s repeated questioning constitute an improper negotiation?" Here's my opinion ...

Did the omission on the paperwork invalidate Linebarger’s bid? No. However, the addition was a correction effecting the bid price and the addition did not offer the same and equal opportunities to renegotiate to the other bidders. Therefore, although there was a omission, the addition/correction was improper, thus, disqualifying.

Did Garcia’s repeated questioning constitute an improper negotiation? Yes. Ramon did not offer the same and equal renegotiation opportunities to to the other bidders. Further, the negotiation was not received through bid "in a fair and confidential manner."

As per punishment ... according to Texas Local Government Code § 271.029, a violation of the bidding process is either a Class B or C misdemeanor. Further, as stated in Texas Local Government Code § 271.030, calls for the immediate removal of the violator from office.

Its all about the lies in McAllen ISD

As stated in NewsChannel 5 "Superintendent's Certification Expires" news report, due to a computer glitch McAllen's Superintendent, Yolanda Chapa's credentials have expired. However a district spokeperson says the inactive status is an error.

There have been many lies from McAllen ISD ... especially from Ms. Chapa. But this one takes the cake. According to the State Board of Education Certification, McAllen Superintendent Yolanda Chapa's Texas educator certificate is inactive. It expired September 30th.

McAllen ISD officials call it a computer glitch. TEA says she may have fulfilled all of the requirements, but she still needs to complete an online application. Where's the computer glitch?

Ok, I see it. The computer glitch is that Yolanda Chapa failed to use the computer. And she's the Super. McAllen ISD can produce astronauts, but not a computer literate Superintendent. Good luck McAllen.

As I mentioned before in “The infamous voting machine,” there are some suspicions regarding the ES&S iVotronic Voting Machine. Since the Help America Vote Act (HAVA) was signed in 2002, Hidalgo County opted to use the ES&S iVotronic Voting Machine, which was certified on May 26, 2004.

Organizations such as VotersUnite! and BlackBoxVoting seem to have major issues with the Diebold system; however, there is list of all the reported problems with the ES&S iVotronic machine, which include lost votes and phantom votes.

Well, here we are again in Hidalgo County and the iVotronic Voting Machines. As stated in the November 8, 2006 “Human Error Blamed for Wrong Tally Vote in Hidalgo County” Team 4 News report, “A programming error … [in the] early voting results in House District 28 put long-shot Constitution Party candidate Ron Avery ahead of popular Democratic incumbent Henry Cuellar by almost 2,000 votes with roughly 2,200 tabulated.”

“The problem was not in the touch screen voting machines, nor the cartridges that record the totals, but in the specific software program written to compile the totals,” said Teresa Navarro, Hidalgo County elections administrator, “It was a coding-slash-programming error.”

Ok, was it a programming error or a human error? True, humans program the machines, but that is a software error … not a human error (an end user error). It makes me wonder … how many other smaller votes in other elections went to unsuspecting candidates by this “human” programming error. Where is the paper trail?

The incident was not serious enough for Texas officials to consider decertifying the company, said Scott Haywood, a spokesman for the Secretary of State.

An approximate 90% error … is “not serious enough.”

Keep an eye on the kickbacks ....

On the City of Edinburg's agenda for November 8, 2006, Joe-Joe is now trying to engourage sales for Hector Casas owned properties and development by placing a monument sign on the intersection of Los Lagos Drive and Raul Longoria, as stated in Section IX Awarding of Bids/Contracts/Resolutions, Subsection H.

Therefore, Joe's third kickback now goes to [drumroll] ... Hector Casas, Joe's favorite campaign worker.

Another item of interest is in Section IX Awarding of Bids/Contracts/Resolutions, Subsection I - Consider proposal of Bond Counsel Services .... I wonder if Joe-Joe is trying to bring in one of his lawyer buddies into this one. Political favor, hummmm? We shall see.

For those of you who read this blog, I tell you. Heavily and with much thought I make this consideration, I feel that I will not post another blog until things in my personal life get better. I only wish that I had the emotional strengh to continue.

As I stated before, in "Jabberwocky," ... I am not a mouthpiece for anyone’s opinions but my own. I write because I can and I write because I choose to write. The day I choose to stop is my choice.

I also stated that the "Love it or leave it is a coward’s slogan. There is more honor in "Love it and get it right. Love it, love it. Love it and never shut up." I only hope that the debate that I helped stir stays the course." With Councilmen such as Gene and Gus and with State Representative Aron Pena, I know that freedom to question authority will survive.

Stay the course, rock the boat and be true to yourself.

For those of you who were reading this blog since the beginning, I have an update for you.

In my very, very first post “Jarvis, Please tell me the truth” I stated,

Don’t forget Eric's law violations on campaign contributions. In the March 06, 2004 “$100,000 in loans to Jarvis' campaign exceed law” newspaper article in The Monitor, Eric cried “oops” to the violations. But once again, look into his recent Campaign Finance Reports, which are available to the public via the internet. Same candidate, same violations and same loans from the same four people ... businessman Pierre Newkirk and three attorneys, Raul Medina, Jesse Villalobos and Javier Villalobos. Eric, are you going to cry “oops” again?

Well, here’s an “oops.” On September 26, 2006, International Bank of Commerce has sued Jesus Villalobos, Jr., Javier Villalobos, Pierre Newkirk & Raul Medina (C-2264-06-F). The Breach of Contract suit is in the 332nd District Court.

No these are not four separate suits but one suit. I wonder if this lawsuit has anything to do with Eric’s most recent run for the 92nd.

Political Ad Paid for by Joe Ochoa

As stated in the October 20, 2006 “Settling into old chair hasn't been easy for Edinburg mayor” article in the Monitor, “The election was over five months ago…” but you’d never guess that from Joe-Joe’s actions. In addition to continually taking shots at the Garcia administration, it seems like Joe-Joe’s more interested in looking good in the paper or on TV than actually doing something of substance.

With everything stated in the article, Ms. Mitchell got some things right.

Joe Ochoa is short.
He narrowly won in May.
Super Splash! was a failure.
Los Lagos failed to attract the expensive homes that it was meant to.

What Ms. Mitchell got wrong, we’ll talk about. Were the errors made purposefully? I don’t know. Either way, she wrote a puff piece for Joe, or Joe lied to her as he does to everyone else.

Sekula Library

The article states Joe-Joe has tried to improve his relationship with the Edinburg School Board. True, there was even a meeting set up between the Edinburg School Board and the Edinburg City Council to discuss the plans for the parking lot of the Sekula Library. However, Joe-Joe cancelled the meeting, giving no reason, and giving no reschedule date.

Why? My guess, Joe is stalling the project. For what purpose? Joe is stalling the project to take a cheap shot at Richard Garcia. How? Joe wants the Sekula Library to open and, at the Grand Opening, he will probably invite all his friends and ask them to take as many individual cars as possible. Therefore, he can announce that it is a beautiful library despite a lack of vision: no parking lot.

Edinburg Police Department

Joe states that the fiasco would not have occurred if Richard Garcia’s Administration “had been vigilant.” Joe-Joe blames Velasco. The real problem in this fiasco is not Velasco Construction. The big problem in this fiasco is the architect, Negrete & Kohlar Architects, Joe’s buddy, who purposely stalled the project.

It is my opinion, from all my research, that Joe instructed/encouraged Negrete to drag his feet and require a lot of change orders to drive up the cost in order afford Joe-Joe a political platform on which to run.

Enriquez Enterprise

This is the big lie in the article. The article states the City Commissioners hired Enriquez Enterprises to finish the police building for an additional $2.2 million. Problem is, no such action was taken. Joe-Joe wants to hire Enriquez Enterprises to finish construction for an additional $2.2 million. However, he wants to do so by appointing Enriquez, therefore, circumventing the bidding process that Councilman Gus Garcia scrutinizes. Gus, where are you on this one?

I previously stated in "All because of Joe-Joe the Clown," Joe got elected and now gives his first kickback to ... [drumroll] ... his college buddy/roomie, David Negrete. Who's next ... Eddie Saenz? Gilbert Enriquez? Jaime Chavana? Hector Casas?

Joe's second kickback now goes to ... [drumroll] ... Gilbert Enriquez, Enriquez Enterprises.

Water Plant Project

In Joe’s first administration, Joe had a choice: build a brand new water plant or build a brand new water park. Joe-Joe, in his infinite vision and wisdom, chose the water park. Because of that, Edinburg is buying expensive water from McAllen, and what’s Joe’s reaction … "oops!" What kind of vision is that?

Now, Joe wants us to pay for the water project by raising our taxes, while Richard Garcia’s Administration already saved money for that project. What’s happening? In short, no pun intended Joe, Joe-Joe is trying to divert the money saved during the Garcia Administration, in to the pockets of his political cronies.

Omar Guerrero ... hurting Hidalgo County

Friday the 13th, unlucky for some. In this instance, Omar Guerrero and especially for the citizens of Hidalgo County.

On October 10, 2006 the Law Office of Cynthia Gutierrez sent Omar Guerrero, Individually and as Hidalgo County District Clerk, her notice of representation of Irene Casares regarding a wrongful termination. The notice states that Lorena Corpus and/or Rosie Ortiz were instructed by Omar Guerrero to fire Irene Casares. The termination occurred within 3 hours after the conclusion. Probably right after he was released from Hidalgo County Jail.

Along with the wrongful termination, Irene Casares may also be filing a complaint against Omar Guerrero for Official Oppression, Texas Penal Code §39.02. In addition, Omar Guerrero may also be in violation of 42 USCA §1983.

So what the demand? Enough to show that Omar Guerrero is hurting the county more than what he is worth.

*** Update ***

Omar's CR-06-885-A DWI and CR-06-2089-A Possessioni of Marijuana are still under advisement regarding Omar's Motion to Suppress. The officer testified to the probable cause. So what's the hold up? Maybe the court and Omar are waiting for 2007, when Omar is out of Office. A DWI conviction is grounds for removal from office.

Regarding Omar's divorce (F-2793-06-2) is set for October 23, 2006 at 1:00 PM for Final Hearing.

Consumers Beware!

When I read the following two articles, I had to do some research. I wondered what these businesses were all about and what they actually do. Here it is.

It has been said, “He who represents himself has a fool for a client and an idiot for a lawyer.” So why then are these self help document preparation services popping up all over the place?

As stated in the May 09, 2006 “AG files suit against Mission man for deceptive trade practices” article in The Monitor, non-lawyer Joel Molano, who “assists” on the document preparation of “divorces, deeds and immigration document services … said he never offers legal advice or tells clients he is an attorney.” The Attorney General’s Office has stated that Molano was actively participating in the unauthorized practice of law.

In his defense, “Molano said he was upset, but not surprised by the lawsuit. He said he met with the AG’s office more than two years ago to discuss his business, but there was no further action. ‘The state has been very well aware of this business,’ Molano said. ‘Why they’re taking this action two-and-a-half year later is beyond me.”

There is also Legal Pro Document Services. Who is Legal Pro Document Services? Legal Pro is owned by a non-lawyer, Rene Garza. He runs multiple businesses from the same address of his “legal-help” shop. Here are the following Assumed Name Certificates run by this man.

Hey, Rene Garza ... How about this for a commercial.

Getting a divorce, go to Rene. Need a place to stay, go to Rene. Need a trailer to move stuff out of your ex’s house into your new home, go to Rene. Truly a one-stop shop.

Another popular service is We the People Forms & Service Center. We the People is owned by a non-lawyer, Martha Wasserman. As stated in Texas UPL Committee website, another business, We the People Forms and Service Centers, U.S.A., Inc., was previously placed under injuction on June 29, 2004 for the the unauthorized practice of law.

As stated in the July 04,2006 “Caution must be taken along path to citizenship” article in The Monitor, “In July 2004, Cameron County State District Court ordered Martha Uresti, who operated Brownsville-based Uresti Immigration/Notary Services, to pay $200,000 in penalties” for actively participating in the unauthorized practice of law.

As stated in Texas Attorney General “Letter Opinion No. 89-078,”

When a person acts for himself or others and undertakes to advise prospective employers or clients by word or course of conduct concerning their legal rights and the prospects of settling personal injury, accident, or other legal claims, thereby encouraging the assertion or prosecution of claims or lawsuits, this person steps beyond the bounds of a legitimate investigation of the facts and engages in the unauthorized practice of law.

Proactive ECISD on Child Welfare

My congratulations to ECISD and Austin Elementary's Principal and Staff for putting kids safety first. As stated in the October 06, 2006 NewsChannel 5 "School Adds New Security Measures" news report, "Austin Elementary in Edinburg is beefing up security after concerns about a child predator in the area."

The active measures taken by the campus include the following: Students who used to wait outside for rides now "wait inside the school and can only get inside a car if his or her name's called. A police officer is on duty full time at the school, and bus drivers walk kids inside the building."

Joe-Joe says he cares about children, he even used them as part of his campaign platform. Now, with the tax freeze, he shifted a future tax burden on them before they even enter kindergarten (just to protect his own assets and political career) while others, like ECISD and Austin Elementary, go out of their way to make a difference.

I bet if ECISD had a say on the sewer problem near Freddy Gonzalez, they would not have made a photo opportunity out of it, they would have actually done something. Ask Freddy Gonzalez administrators and students, when the sewer backs up, the 4th and 2nd grade hallways and the 3th grade and kindergarten bathrooms back flow too. The stink is all around that campus. Freddy Gonzalez is an open air campus.

Channel 4 & 5 ... where are you? Thank you ECISD and Austin Elementary.

The Damage is done ....

... and the Rich will get richer.

As stated in EdinburgPolitics.com “Edinburg adopts city property tax freeze for thousands of elderly, disabled homeowners,” article, “More than 2,300 elderly and disabled homeowners in Edinburg will be able to qualify for a city property tax freeze on their principal home. In addition, the mayor and city council kept the existing $5,450 tax exemption for homeowners age 65 years and older. The tax exemption allows qualified homeowners to reduce the taxable value of their home by $5,450, which decreases their property tax.”

A unanimous vote on the October 3, 2006 Edinburg City Council Meeting, Section X. Consent Agenda, Subsection I, which allowed for the “amending of the Code of Ordinances of the City of Edinburg, Texas, Chapter 33 Finance and Taxation, Section 33.03 by Adding a Provision for a Limitation on Tax Increases for the Elderly and Disabled, as Authorized by Section 11.261, Texas Tax Code,” sealed the deal.

The original Section 33.03 Homestead Exemption for Persons 65 or Older reads,

There is hereby provided an exemption of $5,450 of the assessed value of residence homesteads of persons 65 years of age or older from all ad valorem taxes levied by the city, with the qualification that this exemption, as to the assessed evaluations of homesteads, may be taken but once per family.

Now, Section 33.03 Homestead Exemption for Persons 65 or Older will include a tax freeze for elderly and disabled. That means, as stated in EdinburgPolitics.com, “If the city property tax rate goes up, or the value of the home increases, the dollar amount of taxes paid will never increase for qualified elderly or disabled homeowners.” Joe-Joe stated, “Any loss of income to the city government treasury because their taxes are frozen will have very little impact on our city budget, both now and in the future.”

But remember, as I stated in “Joe wants to dig deeper into your pockets,” Joe-Joe wanted to raise the property values in his Notice of Tax Increase prior to passing the tax-freeze. So the effect here was like that of Corpus Christi, Texas, the elderly saw, right before the passage of the tax freeze, a spike in the valuation of their homes. Here, everyone got a property value increase of 6.79%. The ideology: Raise the values, then freeze the taxes. Yup, you hit ‘em before you hug ‘em.

So who benefits from the tax freeze? It benefits every homeowner age 65 and over, who then can transfer the benefit to their 55 and older surviving spouses. Everyone? Yes. That’s more than 2,300 elderly and disabled homeowners in Edinburg will be able to qualify. Even age 65 and over homeowners who have homesteads over $150,000 to $5,000,000 and up. The 65 over poor and millionaires will get the same benefit. Yes, they get the same $5,450 exemption, which will be minimal for the rich. But they will also get same tax freeze, which will be highly beneficial to the rich.

How many struggling middle-class, 20 to 40 somethings is going to take to fill that hole? Unless the City of Edinburg is planning to increase spending only in relation to the 20 to 40 something property tax yearly revenue, someone has to make up that tax revenue gap. And to think, the tax freeze is irrevocable.

ECISD snafu ....

Just in case you were wondering how the general public could get you name, date of birth and other information, some times this information can be released by your employer ... inadvertantly. If you are an ECISD employee, the RFP 07-84, Employee Census (Excel) and Employee Life Ins Census $30,000 (Excel) had much of the employee information online available to the public for download. Thank Saenz. You are the approved buyer on this RFP.

Up until October 3, 2006 this information was available on the ECISD Puchasing Bids & Proposals Website in an addendum for RFP 07-84. Today, October 4, 2006, the information is back off ... finally. I just hope it was not too late and no identity fraud was initiated.

Speaking of RFP 07-84, the insurance bids. Notice to Purchasing department ... especially Saenz and Flores. Limited to TPA? Third Party Administrators? Why exclude the Major Insurance Companies? Wouldn't they be cheaper for the ECISD employees and better benefits? I am dedicating one eye just for this project. I know what you're trying to do. Don't even think about it. :)

I wanted to be the first to let you know that something is brewing in blogland. I don't know who I might have upset, but notable requests to answer the question "Who is Earn?" are getting more and more serious.

Remember the "Looks like I got a stalker :)" blog regarding Ray Mendoza and his whoisearn.blogspot.com website, well Ray Mendoza, who owns Mendoza Technologies, is a very close friend of Omar Guerrero. Well, since my post of Omar's missing booking pictures, I have been getting a lot of hits on the page.

Omar Guerrero ... again

Here he goes again. What is wrong with this man? Driving While Intoxicated (CR-06-885-A), Possession of Marijuana (CR-06-2089-A), Divorce (F-2793-06-2), Default of Bank Loan (CL-05-1925-E) and now, as states in September 28, 2006 Team 4 "County Clerk Guerrero Charged with Assaulting Wife" newsreport, "Omar Guerrero was then charged with assaulting his wife. He's accused of threatening to kill his wife, grabbing her arm, kicking her on the head and choking her."

Further, "[Omar] Guerrero demanded that Justice of the Peace Mary Alice Palacios remove news reporters and photographers from her courtroom during his arraignment.
But Judge Palacios told [Omar] Guerrero all of the news organizations, including an Action 4 News team, entered the courtroom before she arrived and were entitled to be present."

"Action 4 News Reporter Ray Pedraza brought to the attorneys attention that news crews are allowed at all other arraignments and that Guerrero's arraignment should be no different."

Sorry Omar ... no special treatment. Not from Justice of the Peace Mary Alice Palacios nor from County Court at Law No. 1 Judge Rudy Gonzalez.

Halloween and the Commissioners Court

What is the connection? ... Vampires. It's time to suck blood from the taxpayers. As stated in the Team 4 newsreport "Hidalgo County Commissioners Want $40K Pay Raise for Sheriff, $19K for Themselves," there are some intersesting budget increases for the 2007 tax year for Hidalgo County; pay increases in the 2007 Hidalgo County budget.

Who will benefit from the payraises? Well, there is a "proposed $40,000 yearly raise for the county sheriff, a $19,000 increase for each county commissioner and proposed is a $20,000 raise for the county judge."

What the .... how do they figure? "Precinct 1 Commissioner Sylvia Handy offered an explanation. Handy said since Hidalgo County is the 6th largest in the state, commissioners wanted local salaries to be up to par with the five larger counties in Texas."

As stated in the September 26, 2006 "Commission approves budget, $20k raises for themselves" article in the Monitor,

"Although all county employees will be getting raise using a tiered scale — the lowest paid will receive a 6.75 percent increase and the highest paid non-elected officials will receive the standard 3 percent cost of living increase — the commissioners' jumps in salaries amount to 27 percent."

Now, the average Hidalgo County resident can complain at the open forum, which begins at 9am at the county Administration Building at 100 East Cano in Edinburg. Just ask your boss for the for the time off ... right!?

Give me some Election Protection

I have said it before and I will say it again, Joe stole the election by taking advantage of the elderly and controlling the local adult day care centers. Joe took advantage of the elderly by wheeling them out of their day care centers to vote. If you don’t believe me, go to Joe-Joe’s pharmacy on 10th and see what other establishments are located there. Further, as stated in EdinburgPolitics.com “Joe Ochoa returns as mayor of Edinburg” article, “Ochoa celebrated his big win at a local adult day care center.”

And how did Joe-Joe do this? Manipulating votes through the use of politiqueras and misusing the pollworker/pollwatcher system. Joe had it covered, planned out and ready. Notable Joe-Joe pollwatchers included Hector Casas, Diamantina Gayton and Mary Villarreal.

As stated in Douglas W. Jones article, “Voter 'Assistance'” there is a simple, yet effective way to beat the electronic voting machines … voter assistance. Here it goes.

Method: The [Politiquera] offers to “assist” a voter in casting a ballot. In fact, this assistance consists of either marking or casting the ballot for the voter or looking over the voter’s shoulder to check that the voter is voting as instructed by the [Politiquera]. This often happens in the curb side voting. Notice that the same person (not a pollworker, [but a driver,]) offers assistance to multiple voters.

Each [Politiquera] must have access to a pool of vulnerable voters willing to request “assistance” in return for payment or unable to complain if threatened. Employees, tenants, and those with similar dependency relationships are particularly vulnerable, [such as adult day care centers].

Potential gain: One vote per subverted voter.

Likelihood of detection: An election observer can easily note the frequency with which voters request assistance. Observations of inappropriate assistance are common, but prosecution is rare because voters have a legitimate right to request assistance and it is difficult to prove that the assistant acted improperly.

Preventative measures: Restrict who may assist a voter. [Afford] the voter the right to assistance; [however, require that assistance be] … a close relative, guardian or pollworker/pollwatcher, and require that if pollworkers/pollwatchers offer assistance, they must do so in pairs representing opposing parties.

Gus Garcia & his possible ethics violation

As stated on September 19, 2006 City of Edinburg Council Meeting, Section IX. Awarding of Bids/Contractuals/Resolutions, Item B.

Consider Awarding Bid No. 2006-95, Russell Road Sanitary Sewer Improvements to Flores Development Group, in the amount of $83,670, contingent upon submittal of payment and Performance Bond by September 22, 2006. In the event that Flores Development Group is not able to provide the necessary documents by the deadline, staff recommends awarding the bid to Saenz Utility Contractors, from Weslaco, Texas, the second lowest bidder, in the amount of $145,030, contingent upon submittal of Payment and Performance Bond.

Well, who is this new kid on the block … Flores Development Group? A simple internet search of the name gives the following information: Flores Development Group, Inc., 519 W University Dr, Edinburg, TX, United States, Phone: (956) 287-7100. But when I drove by the address there was a business called Flores Engineering. By the way guys, cut your grass.

Here it goes. Flores Engineering belongs to Raul P. Flores who has his DBA document number 1623097. The other business is Flores Development Group, Inc. which, according to the Texas Comptroller of Public Accounts, belongs to Robert Ray Flores, Raul’s son. Further, Flores Development Group, Inc. uses the same address and phone as his dad’s business, yet there is no indication that such group even does business out of that building.

So what is the connection? Gus Garcia, the very man who in previous council meetings complained of bidders too pricey, was actually advocating for his longtime friend and football buddy, in the September 19, 2006 City Council meeting, stating that maybe Robert “Robbie” Flores should raise his prices.

But why the conditional approval? Once again look at the history. Remember as I stated in “A Very Thin Line,” Gus Garcia always said he could get lower prices and Mayor Pro-Tem Gene Espinoza always asked Gus if those businesses were “bonded.” Well, Gus’ buddy, Robert “Robbie” Flores, will get the contract only if he submits a Payment and Performance Bond by September 22, 2006. Is it not required that Flores Development Group, Inc. even be a corporation in good standing? Because he is not.

I wonder, is Gus trying to get his buddies business with the City of Edinburg by helping them with the bidding process?

Thanks for cutting the grass, guys. Beautification of Edinburg is always good. You should have petitioned Joe-Joe for money, he gives away stuff like that. Maybe you could have got a road too!
